Tax Credit Bonds for Bureau of Indian Affairs-Funded Schools


Section 54F(d)(4), in Section III of the American Recovery and Reinvestment Act states:


‘‘(4) ALLOCATIONS FOR INDIAN SCHOOLS.—In addition to the

amounts otherwise allocated under this subsection,

$200,000,000 for calendar year 2009, and $200,000,000 for calendar

year 2010, shall be allocated by the Secretary of the

Interior for purposes of the construction, rehabilitation, and

repair of schools funded by the Bureau of Indian Affairs. In

the case of amounts allocated under the preceding sentence,

Indian tribal governments (as defined in section 7701(a)(40))

shall be treated as qualified issuers for purposes of this subchapter.


In order to implement this section, the Department of the Interior must solicit applications for the qualified school construction bonds. Because the ARRA limits the appropriation of $200,000,000 to calendar year 2009, Interior must solicit applications as soon as possible. The application solicitation is an information collection requiring approval under the Paperwork Reduction Act.


We are therefore seeking emergency approval of this information collection and a waiver of the requirement to publish the 60-day and 30-day Federal Register notices.
