Form 13369
1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION
The office of Appeals was required to expand its mediation procedures by the Restructuring and Reform Act (RRA Sec. 3468) under Section 7123 of the Internal Revenue Code. As a result, the Fast Track Mediation pilot program was initiated and is currently in place as a formal program. If the taxpayer and the Service wish to participate in the program, they must complete and sign an “Agreement to Mediate” form. The information is also collected under the authority of 26 U.S.C. 7801.
2. USE OF DATA
The Agreement to mediate the form will be sent to the office of Appeals to schedule a mediation session. Once a session is scheduled, a mediator will meet with the taxpayer and the Compliance officer to attempt to resolve the case.
USE OF IMPROVED INFORMATION TECHNOLOGY TO REDUCE BURDEN
We have no plans at this time to offer electronic filing because of the low volume compared to the cost of electronic enabling.

We have attempted to eliminate duplication within the agency wherever possible.

Periodic meetings are held between IRS personnel and representatives of the American Bar Association, the National Society of Public Accountants, the American Institute of Certified Public Accountants, and other professional groups to discuss tax law and tax forms. During these meetings, there is an opportunity for those attending to make comments regarding Form 13369.
In response to the Federal Register Notice dated July 13, 2009, (74 F.R. 33513), we received no comments during the comment period regarding Form 13369.

RESPONDENTS

13. ESTIMATED TOTAL ANNUAL COST BURDEN TO RESPONDENTS
As suggested by OMB, our Federal Register Notice dated July 13, 2009, requested public comments on estimates of cost burden that are not captured in the estimates of burden hours, i.e., estimates of capital or start-up costs and costs of operation, maintenance, and purchase of services to provide information. However, we did not receive any response from taxpayers on this subject. As a result, estimates of the cost burdens are not available at this time.
14. ESTIMATED ANNUALIZED COST TO THE FEDERAL GOVERNMENT
Form 13369 will be a “print on demand” therefore there will be no cost for printing.
15. REASONS FOR CHANGE IN BURDEN
There is no change in the paperwork burden previously approved by OMB. We are making this submission to renew the OMB approval.
