This collection is approved with the following terms of clearance: HUD is approved an emergency clearance for the collection to meet the American Reinvestment Recovery Act requirements. This collection will be valid for 180 days. If HUD decides to continue use of the form past the approved emergency clearance time period, they must resubmit to OMB under the normal PRA clearance process for a three year approval. Any future resubmissions that include the use of standard forms should not include in the burden the burden associated with the standard forms. Additionally, in accordance with OMB guidance, paper-based applications are not acceptable as a sole method of transmission. HUD must provide, in conjunction with paper-based application transmissions, an electronic alternative such as email, file transfers, systems, etc. for applicants to submit the application. This approval does not include any utility consumption monitoring of program participants.

HUD's Office of Affordable Housing Preservation must collect certain data to administer the Green Retrofit Program(GRP) authorized by the Recovery Act. The legislation includes reporting requirements for all recipients of Recovery Act funds. The data being collected will track the progress of work funded under the GRP and report compliance with program requirements. Respondents will be loan and grant recipients (owners of eligible properties) and contractors hired by HUD to perform certain GRP activities.

Rutledge OMB Desk Officer Office of Management and Budget New Executive Office Building Washington, DC 20503 Dear Mr. Rutledge: The Department is seeking emergency review of the Paperwork Reduction Act requirements contained in the “Retrofit Funding Agreement-Green Retrofit Program” and the “Utility Consumption Report– Green Retrofit Program”. The Notice of Paperwork Submission (copy enclosed), proposed for immediate Federal Register publication, explains the burden of the collection requirements and invites public comments on them. This is a new information collection. In compliance with the requirements of 5 CFR 1320.13, this letter requests emergency processing within 14 days from the date of publication. This emergency processing is essential to the immediate implementation of the Green Retrofit Program which authorizes HUD to make loans, make grants, and take a variety of other actions to facilitate utility-saving investments and other investments that produce environmental benefits, in certain existing HUD-assisted multifamily housing, subject to agreement between HUD and the Owner. The Green Retrofit Program is authorized by Title XII of the American Recovery and Reinvestment Act of 2009, P. L. 111-5 (the “Recovery Act”), in the section titled “Assisted Housing Stability and Energy and Green Retrofit Investments” under “Housing Programs”. The Secretary must take steps necessary to ensure that owners receiving funding for energy and green retrofit investments under the Recovery Act must expend such funding within 2 years of the date they receive the funding. To ensure that owners complete the agreed-upon retrofits and expend funds as scheduled, OAHP will use the Retrofit Funding Agreement- Green Retrofit Program (“RFA”) to control the expenditure of loan and grant funds, and to monitor and track owners’ progress towards completion of the scheduled work for each property. The RFA must be in place before any retrofits may be commenced and funded; therefore immediate use of this form is critical to the implementation of the Green Retrofit Program section of the Recovery Act. Additionally, the Recovery Act provides that the Secretary may share in a portion of future property utility savings resulting from improvements made by grants or loans made available under the GRP. In order to determine the utility savings, utility consumption must be measured both pre- and post- retrofit and the results compared. The Utility Consumption Agreement- Green Retrofit Program will be used to report the baseline utility consumption prior to retrofits; it will be used a second time to report utility consumption one year after all retrofits have been completed.
