major areas of a participant's management operations. The
information is used to assess the management performance of
PHAs.

seeking emergency review of the Paperwork Reduction Act
requirements contained in the Public Housing Assessment System
(PHAS): Management Operations Certification request. The Notice of
Proposed Information Collection for Public Comment (copy enclosed),
proposed for immediate Federal Register publication, explains the
burden of the collection requirements and invites public comments
on them. This is a reinstatement without change of a previously
approved collection which was discontinued. In compliance with the
requirements of 5 CFR 1320.13, this letter requests emergency
processing within 14 days from the date of publication. This
emergency processing is essential to the Department in order to
assess and issue PHAS scores, based on the current PHAS rule, to
public housing agencies (PHAs) with fiscal years ending June 30,
2009, September 30, 2009, December 31, 2009, and March 31, 2010.
The Department published a new PHAS proposed rule in the Federal
Register for the Public Housing Assessment System on August 21,
2008, with the comment period ending January 8, 2009. The changes
to the current PHAS rule are necessary in order to fully implement
asset management at public housing agencies (PHAs) pursuant to 24
CFR part 990. It was anticipated that the rule would be implemented
for PHAs with fiscal year ending June 30, 2009, and therefore, the
Paperwork Reduction Act documentation for the management operations
certification was not extended. PHAs with fiscal years ending June
30, 2008, through March 31, 2009, were not assessed and did not
receive a PHAS score. The Departments Office of General Counsel
has determined that a PHAS score shall be issued for PHAs with
fiscal years ending June 30, 2009, through March 31, 2010, under
the current PHAS rule. Since the fiscal year end June 30, 2009,
PHAs need to submit their management operations certifications as
soon as possible, the Department is requesting an emergency review
of this Paperwork Reduction Act submission. Upon approval of this
request, the Department will initiate the submission of an
extension of a currently approved collection. Enclosed you will
find a copy of the management operations certification form that
the Department is proposing PHAs use for the collection of this
information, as part of the Paperwork Reduction Act submission.

This is a reinstatement of a
previously discontinued collection. The collection was discontinued
because it was not being funded for a period of time. HUD has
steady-state maintenance for the management operations subsystem,
and will be utilizing the management operations certification and
subsystem for PHAs with fiscal years ending June 30, 2009, through
March 31, 2010.
