Justification for No material/Nonsubstantive Change


The Department is hereby submitting updated Form 300, Application to the U. S. Department of Labor for Expedited Review of Denial of COBRA Premium Reduction and Form 301, Plan Sponsor/Plan Administrator Information Sheet, as a no material/nonsubstantive change request to OMB Control 1210-0135. These documents have been revised to reflect changes to the COBRA notification requirements made by the American Recovery and Reinvestment Act of 2009 (“AARA”) as amended by the Department of Defense Appropriations Act, 2010, which was signed by President Obama on December 19, 2009 (Pub. L. 111-118), and the Tax Extensions Act of 2010 (TEA), which was signed by the President on March 2, 2010. Specifically, Assistance Eligible Individuals now can be eligible for the subsidy if they incur an involuntary termination of employment triggering a COBRA election opportunity by March 31, 2010. Before the extension, Assistance Eligible Individuals had to experience an involuntary termination of employment by February 28, 2010. The forms also have been revised to reflect a correction to the premium assistance program that provides individuals who incurred a reduction in hours followed by an involuntary termination of employment to be eligible for the subsidy. The information collected on the documents has not changed.
