Justification for No material/Nonsubstantive Change
The Department is hereby submitting updated Form 300, Application to the U. S. Department of Labor for Expedited Review of Denial of COBRA Premium Reduction and Form 301, Plan Sponsor/Plan Administrator Information Sheet, as a no material/nonsubstantive change request to OMB Control 1210-0135. These documents have been revised to reflect changes to the COBRA notification requirements made by the American Recovery and Reinvestment Act of 2009 (“AARA”) as amended by the Continuing Extensions Act of 2010, which was signed by President Obama on April 15, 2010. Specifically, Assistance Eligible Individuals now can be eligible for the subsidy if they incur an involuntary termination of employment triggering a COBRA election opportunity by May 31, 2010. Before the extension, Assistance Eligible Individuals had to experience an involuntary termination of employment by March 31, 2010. The information collected on the documents has not changed.
