Emergency Justification for Health Care Reform Insurance Web Portal and Supporting Authority Contained in Sections 1103 and 10102 of The Patient Protection and Affordability Care Act, P.L. 111-148 (PPACA)



In accordance with Section 1103 of The Patient Protection and Affordability Care Act, H.R. 3590 (PPACA) the U.S. Department of Health and Human Services (DHHS) is tasked with developing and implementing an Internet website portal to assist consumers with identifying affordable and comprehensive health insurance coverage options that are available in their State.


The statute requires the web portal to be functioning by July 1, 2010. Due to the urgency and the short time frames associated with this requirement, CMS does not have sufficient time to allow for the usual comment timeframe required in the PRA process. We are requesting an Emergency Review for the first two phases, and only a 3 week comment period in which we will consider comments, but not implement any changes until after the September 1, 2010 release. However, we also request that OMB review be completed by April 26, 2010 to allow us to begin collection in May.
