The Magnuson-Stevens Act was amended
on July 11, 2006, by the Coast Guard Act (Public Law 109-241) to
replace all of the existing language in section 305(i)(1) with new
language. The new requirements address all aspects of management
and oversight of the Community Development Quota (CDQ) Program
including: the purpose of the CDQ Program; allocations of
groundfish, halibut, and crab to the program; allocations of
program allocations among the CDQ entities; management of the CDQ
fisheries; which communities may participate in the program;
eligibility criteria for participation in the program; limits on
allowable investments; the creation of a CDQ administrative panel;
compliance with State reporting requirements; a decennial review
and allocation adjustment process; and other features of program
administration and oversight by the State and NMFS. The
Magnuson-Stevens Act was amended again on January 12, 2007, by
Public Law 109-479 to revise transfers of quotas among the CDQ
entities. All but four data elements are removed from this
collection-of-information; however, as the renewal is in process,
this request is in the form of a temporary new
collection-of-information.
