TD 8172



  1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION


IRC section 6036 requires that receivers, trustees in bankruptcy, assignees for the benefit of creditors, or other like fiduciaries, and all executors shall notify the district director within 10 days of appointment. The regulations provide that the notice shall include the name and location of the Court and when possible, the date, time, and place of any hearing, meeting or other scheduled action. By regulation, the reporting requirement has been eliminated as to bankruptcy trustees, debtors in possession and other fiduciaries in a bankruptcy proceeding.

  1. USE OF DATA


This information is needed so that IRS will know with whom to conduct an investigation and make any claim in the proceeding for any taxes due.

  1. USE OF IMPROVED INFORMATION TECHNOLOGY TO REDUCE BURDEN


IRS Publications, Regulations, Notices and Letters are to be electronically enabled on an as practicable basis in accordance with the IRS Reform and Restructuring Act of 1998.

A notice of proposed rulemaking was published in the Federal Register on August 25, 1972. After consideration of all such relevant matters as was presented by interested persons, the regulation was adopted. The regulation was amended on January 29, 1988, to eliminate the notice requirement as to a bankruptcy trustee, debtor in possession or other like fiduciary in a bankruptcy proceeding.

We received no comments during the comment period in response to the Federal Register notice dated May 20, 2010,(75 FR 28324).

  1. EXPLANATION OF DECISION TO PROVIDE ANY PAYMENT OR GIFT TO RESPONDENTS

  1. ASSURANCE OF CONFIDENTIALITY OF RESPONSES


Generally, tax returns and tax return information are confidential as required by 26 USC 6103.


  1. JUSTIFICATION OF SENSITIVE QUESTIONS


Not applicable.


  1. ESTIMATED BURDEN OF INFORMATION COLLECTION


Section 301.6036-1 requires the executors or receivers to advise the District Director of their appointment or authorization to act. We estimate that 50,000 notices are sent to IRS. The notice sent to I.R.S. is merely a copy of the notice required to be sent to other creditors in the proceeding and should not require in excess of .25 hours. Therefore, the total burden imposed by this regulation is 12,500 hours.

Estimates of the annualized cost to respondents for the hour burdens shown are not available at this time.

  1. ESTIMATED TOTAL ANNUAL COST BURDEN TO RESPONDENTS


As suggested by OMB, our Federal Register notice dated May 20, 2010,(75 FR 28324) requested public comments on estimates of cost burden that are not captured in the estimates of burden hours, i.e., estimates of capital or start-up costs and costs of operation, maintenance, and purchase of services to provide information. However, we did not receive any response from taxpayers on this subject. As a result, estimates of the cost burdens are not available at this time.

  1. REASONS FOR CHANGE IN BURDEN


There is no change in the paperwork burden previously approved by OMB. We are making this submission to renew the OMB approval.

  1. REASONS WHY DISPLAYING THE OMB EXPIRATION DATE IS INAPPROPRIATE


We believe that displaying the OMB expiration date is inappropriate because it could cause confusion by leading taxpayers to believe that the regulation sunsets as of the expiration date. Taxpayers are not likely to be aware that the Service intends to request renewal of the OMB approval and obtain a new expiration date before the old one expires.
