The Poverty Guidelines will be used as a guide, but not as a conclusive standard, in adjudicating fee waiver requests for employment authorization applications requiring a fee. If you have a pending Form I-485, and you are filing Form I-765, you must include a copy of the I-797C Notice of Action showing that your application was accepted.
