On August 9, 2010, OSHA published in the Federal Register the final rule on Cranes and Derricks in Construction (Subpart CC). When OSHA submitted the final rule to the Office of the Federal Register (OFR), the rule included cranes and derricks used in demolition and underground construction under Subpart CC. However, separate regulatory text in an appendix to Subpart CC covered cranes and derricks used in demolition and underground construction; the regulatory text in this appendix duplicated the former cranes and derricks standard at 29 CFR 1926.550 (cleared under OMB Control number 1218-0113). (This approach was necessary because the proposed rule did not include these cranes and derricks in the scope of the new rule.) Prior to publication of the final rule, OFR removed the regulatory text from the appendix and redesignated it as 29 CFR Part 1926.1501 under Subpart DD (75 FR 48134). Based on publication of the new rule, OSHA discontinued the clearance for 1926.550, and combined the former ICR into the ICR for Subpart CC; because of the OFR action, OSHA must now retitle that ICR to include Subpart DD. OSHA included the paperwork burden hours and costs for cranes and derricks used in demolition and underground constructions in the ICR for Subpart CC (based on the assumption that the regulatory text would remain in the appendix in Subpart CC); therefore, transferring the requirements for cranes and derricks used in demolition and underground constructions from Subpart CC to Subpart DD will not increase the total burden hours and costs for these subparts.
