This collection of information is
required by the Trademark Act, 15 U.S.C. et seq., and is
implemented through the Trademark rules set forth in 37 CFR Part 2.
Individuals and businesses that use, or intend to use, such marks
in commerce may file an application to register their marks with
the USPTO. They can also submit various communications concerning
their pending applications or registered trademarks. In the
majority of cases, individuals and businesses retain attorneys to
handle these matters. This collection provides for the various
activities related to the appointment and retention of attorneys of
record or domestic representatives. Applicants and registrants may
also submit change of address forms requesting that the USPTO amend
the record of an application or registration by entering a new
address. The information in this collection can be submitted in
paper format or electronically through the Trademark Electronic
Application System (TEAS). In addition to the original TEAS forms,
the USPTO has developed a new TEAS Global Form format that permits
the agency to collect information electronically when a TEAS form
with dedicated data fields is not available. The USPTO proposes to
add three TEAS Global Forms for changing the domestic
representative's address, replacing the attorney of record with
another already appointed attorney, and requesting the withdrawal
of a domestic representative into the collection. The paper
equivalents for these items will also be added.
This information collection is
currently approved with 160,004 responses, 12,491 burden hours, and
$7,317 in annualized (non-hour) costs. For this renewal, the USPTO
estimates that this collection will have 123,010 responses and
10,927 burden hours, which is a reduction of 36,994 responses and
1,564 burden hours. The USPTO estimates the new TEAS Global Forms
and their paper equivalents will add 59 burden hours to the
collection. The USPTO also estimates that 1,087 burden hours will
be added due to administrative adjustments caused by estimated
increases in responses and completion times. However, the USPTO
estimates that this will be offset by a reduction of 2,710 burden
hours from reduced filings. The USPTO estimates that this
collection will have a net burden decrease of 1,564 hours, with an
increase of 59 hours from program changes offset by a reduction of
1,623 hours from administrative adjustments. The USPTO also
estimates that this renewal will reduce $4,791 in annual (non-hour)
postage costs, for a total of $2,526 per year. The USPTO estimates
that $14 will be added from program changes, but will be offset by
a reduction of $4,805 due to administrative adjustments. The USPTO
estimates that this collection will have a net total reduction of
$4,791 in annual (non-hour) costs, with an increase of $14 from
program changes offset by a decrease of $4,805 from administrative
adjustment.
