This information collection request
(ICR) renewal pertains to EPA's Facility Response Plan (FRP)
requirements as codified in 40 CFR 112.20 and 112.21. This
regulation implements requirements mandated by the Oil Pollution
Act (OPA) of 1990. Facilities subject to the FRP rule are a subset
of the facilities regulated by the EPAs Spill Prevention, Control
and Countermeasure (SPCC) rule. The SPCC regulation (40 CFR 112)
requires all non-transportation-related facilities with an
aboveground oil storage capacity of 1,320 gallons or more, located
where there is a possibility of a discharge into navigable water,
to prepare site-specific plans to prevent oil discharges. The FRP
rule adds additional requirements for those owners and operators of
facilities that could cause "substantial harm" to the environment
by discharging oil into navigable water bodies or adjoining
shorelines prepare plans for responding, to the maximum extent
practicable, to a worst case discharge of oil, and to a substantial
threat of such a discharge. The total burden on the entire FRP
regulated community over a three-year period is estimated to be
1,297,880 hours (adjusted for burden attributable to compliance
with State and other Federal regulations). The estimated costs
include approximately $88,449 in capital costs over the three-year
period and $52,283,484 in total costs (including labor costs
associated with facility and contractor personnel). EPA does not
anticipate that FRP facilities will incur operating and maintenance
(O&M) costs since there are no anticipated costs associated
with hard copy or electronic document storage.
