SUPPORTING STATEMENT FOR THE

INFORMATION COLLECTION REQUIREMENTS OF THE OSHA-7 FORM

(“NOTICE OF ALLEGED SAFETY AND HEALTH HAZARDS”)

(Office of Management and Budget (OMB) Control No. 1218-0064)

OSHA is making a non-substantive change to the currently approved collection of information requirements contained in the OSHA-7 form, “Notice of Alleged Safety and Health Hazards,” to include a Spanish-language version of the electronic form and instructions. This web-based form establishes a means to accept complaints from Spanish-speaking workers through the Internet, in furtherance of the Agency’s on-going efforts to reduce injuries and illnesses among Latino workers by enhancing knowledge of their workplace rights and improving their ability to exercise those rights.

Historically, OSHA-7 complaints from Spanish-speaking workers could be filed orally, via OSHA’s 800 number or in-person, or in writing; however, the web-based version of the form was not available in Spanish. OSHA provides Spanish-speaking operators on its 800 number and Spanish-speaking personnel in the field who provide assistance to workers during the complaint filing process.

When a worker completes and sends the OSHA-7 form online, it goes directly to the OSHA area office nearest to the workplace identified on the form. As indicated in the March 2011 Supporting Statement, based on interviews with compliance officers in several area offices, the Agency estimated that approximately 20% of the 50,715 complaints (10,143 complaints) received in calendar year 2009 were submitted on-line. The addition of the Spanish-version of the form does not change existing burden hour or cost estimates for this ICR, as Spanish-language complaints were accepted by other means in calendar year 2009.
