SUPPORTING STATEMENT




1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION


Internal Revenue Code Sections 35 and 7527 enacted by public law 107-210 (see attachment) require the Internal Revenue Service to provide payments of the HCTC to eligible individuals beginning August 1, 2003. The IRS will use these forms to ensure, that the processes and communications for delivering these payments help taxpayers determine if they are eligible for the credit and understand what they need to do to continue to receive it.


Health plan administrators (HPAs) will use this form to submit information changes to the IRS Health Coverage Tax Credit (HCTC) Program.


The collections of information in these forms are necessary to ensure that the HCTC program has the most current and accurate information relating to HPAs.

2. USE OF DATA


The Internal Revenue Service will review the information submitted by the HPAs and make the appropriate changes to the records relating to the HCTC program.

We have no plans at this time to offer electronic filing because of the low volume compared to the cost of electronic enabling.

We have attempted to eliminate duplication within the agency wherever possible.


5. METHODS TO MINIMIZE BURDEN ON SMALL BUSINESSES OR OTHER SMALL ENTITIES

OF INSTRUCTIONS AND FORMS, AND DATA ELEMENTS


Periodic meetings are held between IRS personnel and representatives of various professional groups to discuss tax law and tax forms. During these meetings, there is an opportunity for those attending to make comments regarding the collection requirements under these forms.


In response to the Federal Register notice (76 FR 18301), dated April 1, 2011, we received no comments during the comment period regarding these forms.

RESPONDENTS

10. ASSURANCE OF CONFIDENTIALITY OF RESPONSES


Generally, tax returns and tax return information are confidential as required by 26 USC 6103.

13. ESTIMATED TOTAL ANNUAL COST BURDEN TO RESPONDENTS


As suggested by OMB, our Federal Register Notice dated April 1, 2011, requested public comments on estimates of cost burden that are not captured in the estimates of burden hours, i.e., estimates of capital or start-up costs and costs of operation, maintenance and purchase of services to provide. However, we did not receive any response from taxpayers on this subject. As a result, estimates of the cost burdens are not available at this time.


14. ESTIMATED ANNUALIZED COST TO THE FEDERAL GOVERNMENT


After consultation with various functions within the Service, we have determined that the cost of developing, printing, processing, distribution and overhead for the form is $500.


15. REASONS FOR CHANGE IN BURDEN


There is no change in the paperwork burden previously reported to OMB. We are making this submission to renew the OMB approval.


16. PLANS FOR TABULATION, STATISTICAL ANALYSIS AND PUBLICATION
