“eForm Access Request/User Registration”



A. JUSTIFICATION


1. Participants in an electronic filing system developed by ATF will use

an on-line electronic registration process. This process will replace the ATF F 5013.3, eForm Access Request. The ATF eForms System will provide the capability for the electronic submission of applications filed within the Firearms and Explosives Services Division, specifically, ATF F 6 Part 1, Application and Permit for Importation of Firearms, Ammunition and Implements of War, Form 6 Part II, Application and Permit for Importation of Firearms, Ammunition and Implements of War (for use by members of the U.S. Armed Forces), Form 6 NIA, Application and Permit for Temporary Importation of Firearms and Ammunition by Nonimmigrant Aliens, Form 6A, Release and Receipt of Firearms, Ammunition, and Implements of War, ATF Form 1, Application to Make and Register a Firearm, ATF Form 2, Notice of Firearms Manufactured or Imported, ATF Form 3, Application for Tax-Exempt Transfer of Firearm and Registration to Special (Occupational) Taxpayer (National Firearms Act), ATF Form 4, Application for Tax Paid Transfer and Registration of Firearm, ATF Form 5, Application for Tax Exempt Transfer and Registration of Firearm, ATF Form 9, Application and Permit for Permanent Exportation of Firearms, ATF Form 10, Application for Registration of Firearms Acquired by Certain Governmental Entities, ATF Form 5630.7, Special Tax Registration and Return National Firearms Act (NFA) or ATF Form 3310.4 Report of Multiple Sale or Other Disposition of Pistols and Revolvers. ATF has designed an electronic filing program which requires a password for access to the system. Although electronic filing of the previously mentioned forms is voluntary, participants must submit certain information about themselves to meet DOJ and ATF computer security requirements. The information required to issue User ID’s and allowing for the creations and maintaining of passwords involves collecting Privacy Act information. The information submitted by the applicants will be used to associate them with a particular ATF issued license, permit, registration or application. ATF requires this information under the authority of 18 U.S.C. 925(d).


2. The information on the electronic registration form will be used by ATF to authenticate end users in the system to electronically file an ATF F 6 Part 1, Application and Permit for Importation of Firearms, Ammunition and Implements of War, Form 6 Part II, Application and Permit for Importation of Firearms, Ammunition and Implements of War (for use by members of the U.S. Armed Forces), Form 6 NIA, Application and Permit for Temporary Importation of Firearms and Ammunition by Nonimmigrant Aliens, Form 6A, Release and Receipt of Firearms, Ammunition, and Implements of War, ATF Form 1, Application to Make and Register a Firearm, ATF Form 2, Notice of Firearms Manufactured or Imported, ATF Form 3, Application for Tax- Exempt Transfer of Firearm and Registration to Special (Occupational) Taxpayer (National Firearms Act), ATF Form 4, Application for Tax Paid Transfer and Registration of Firearm, ATF Form 5, Application for Tax Exempt Transfer and Registration of Firearm, ATF Form 9, Application and Permit for Permanent Exportation of Firearms, ATF Form 10, Application for Registration of Firearms Acquired by Certain Governmental Entities, ATF Form 5630.7, Special Tax Registration and Return National Firearms Act (NFA) or ATF Form 3310.4 Report of Multiple Sale or Other Disposition of Pistols and Revolvers. The system will authenticate end users by comparing information submitted on the form to records held in multiple, independently sourced databases, such as postal address. By checking multiple sources, often with an overlapping scope of coverage, the verification engine will facilitate the authentication process and reduce the possibility of fraud. The authentication will also be used for the creation of electronic signatures that will take the place of handwritten signatures, as outlined in the Electronic Signatures in Global and National Commerce Act. ATF will also use this form to ensure that the information submitted by the users (company name, address, license number, etc.) matches what is contained in our databases. This will ensure accuracy in reporting data from electronically filed transactions.


3. The eForms registration form will be available on ATF’s Internet site and must be completed and submitted electronically. The collection of information gathered from this form will be used to authenticate users in the electronic database. For security reasons and as confirmation of the email address the user IDs will be forwarded to users. The user will create their password as part of the electronic registration process.


4. ATF uses a uniform subject classification system to identify duplication and to ensure that any similar information already available cannot be used or modified for use for the purpose of this information collection.


5. ATF does not have any methods to reduce the impact on small businesses, since all entities, regardless of size, are required to complete this application to gain access to the electronic filing system.

ATF F 6 Part 1, Application and Permit for Importation of Firearms, Ammunition and Implements of War, Form 6 Part II, Application and Permit for Importation of Firearms, Ammunition and Implements of War (for use by members of the U.S. Armed Forces), Form 6 NIA, Application and Permit for Temporary Importation of Firearms and Ammunition by Nonimmigrant Aliens, Form 6A, Release and Receipt of Firearms, Ammunition, and Implements of War, ATF Form 1, Application to Make and Register a Firearm, ATF Form 2, Notice of Firearms Manufactured or Imported, ATF Form 3, Application for Tax-Exempt Transfer of Firearm and Registration to Special (Occupational) Taxpayer (National Firearms Act), ATF Form 4, Application for Tax Paid Transfer and Registration of Firearm, ATF Form 5, Application for Tax Exempt Transfer and Registration of Firearm, ATF Form 9, Application and Permit for Permanent Exportation of Firearms, ATF Form 10, Application for Registration of Firearms Acquired by Certain Governmental Entities, ATF Form 5630.7, Special Tax Registration and Return National Firearms Act (NFA) or ATF Form 3310.4 Report of Multiple Sale or Other Disposition of Pistols and Revolvers can be filed electronically. The processing and approving of these applications is capable only if the respondent completes this information collection. If the information on this form is not submitted the users will not be granted a user ID and password and cannot participate in the electronic filing system.


7. There are no special circumstances associated with this collection. This information collection requirement is conducted in a manner consistent with 5 CFR 1320, Controlling Paperwork Burdens on the Public, Section 6.


8. ATF staff from the Firearms and Explosives Services Division created the form. The DOJ Criminal Division, Computer Crime and Intellectual Property Section reviewed the form and suggested that there must be one responsible person per entity registering. Those references have been included on the form. A 60-day and 30-day Federal Register Notice was published in order to solicit comments from the public. No comments were received.


9. No payment or gift is associated with this collection.


10. This form will be maintained in a secure file room in Bureau Headquarters. Moreover, 5 U.S.C. 552 protects the confidentiality of information obtained by the government from regulated individuals. Confidentiality is not assured.


  1. Information of a sensitive nature is required. The SSN, EIN, date of birth and mother’s maiden name are requested to verify the identity of individuals requesting passwords. This information will be compared to records in other databases to authenticate the users.


  1. The number of respondents associated with this information collection is 500. The respondents will only need to complete this form once to receive a userid password to access the electronic filing system. The number of responses is 500. Each form should take an average of 3 minutes for the paper form and 2.24 minutes for the electronic submission per applicant to complete. The total burden associated with this information collection is 25 hours for the completion of the paper form and 18.6 for the completion of the electronic form.

13. The cost to the respondent is postage which is estimated as $220.00. The cost will not be reported on the 83-I because OMB asks for the cost burden in thousands of dollars.


  1. It is estimated it will cost $50.00 to the Federal Government to print 1,250 copies of this form.


  1. There are no program changes or adjustments associated with this information collection.


16. The results of this collection will not be published.


17. ATF does not request approval to not display the expiration date of OMB approval for this collection.


18. There are no exceptions to the certification statement.
