SUPPORTING STATEMENT (REG-140029-07 (NPRM)


  1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION


The proposed regulation provides guidance under subsection 170(f)(11) regarding substantiation and reporting requirements for charitable contributions, which was added by the Jobs Act of 2004 and amended by the Pension Protection Act of 2006 (PPA). The proposed regulation also provides guidance under subsection 170(f)(17) regarding recordkeeping requirements to substantiate cash, check, or other monetary gifts, which was added by the PPA.


  1. USE OF DATA


The information collected under § 170(f)(11) will be used by taxpayers to substantiate claimed charitable contribution deductions in excess of $500; some of the information will be required to be included with the taxpayer's tax return. The information collected under § 170(f)(17) will be used by taxpayers to substantiate claimed charitable contributions of cash, check, or other monetary gifts; the information must be maintained by taxpayers but will not be required to be included with the taxpayer's return.


  1. USE OF IMPROVED INFORMATION TECHNOLOGY TO REDUCE BURDEN


There are no plans to provide electronic filing because electronic filing is not appropriate for the collection of information in this submission.


  1. EFFORTS TO IDENTIFY DUPLICATION


Duplication of taxpayer efforts was eliminated by allowing taxpayers to satisfy different requirements with one document.


5. METHODS TO MINIMIZE BURDEN ON SMALL BUSINESSES OR OTHER SMALL ENTITIES


Burden on small entities were minimized by allowing flexibility in definitions of certain terms.

Periodic meetings are held between IRS personnel and representatives of the American Bar Association, the National Society of Public Accountants, the American Institute of Certified Public Accountants, and other professional groups to discuss tax law and tax forms. In response to the Federal Register notice dated Aug. 7, 2008, we received no comments regarding Regulation 140029-07.


In response to the Federal Register Notice dated November 8, 2011 (76 FR 69330), we received no comments during the comment period regarding Regulation 140029-07.

Generally, tax returns and return information are confidential as required by 26 USC 6103.


11. JUSTIFICATION OF SENSITIVE QUESTIONS

  1. ESTIMATED BURDEN OF INFORMATION COLLECTION


The estimate of the number of Responses is 201,920.

The total estimated burden is 226,419 hours.


Estimates of the annualized cost to respondents for the hour burdens shown are not available at this time.


13. ESTIMATED TOTAL ANNUAL COST BURDEN TO RESPONDENTS


As suggested by OMB, our Federal Register Notice dated November 8, 2011 (76 FR 69330), requested public comments on estimates of cost burden that are not captured in the estimates of burden hours, i.e., estimates of capital or start-up costs of operation, maintenance, and purchase of services to provide information. However, we did not receive any response from taxpayers on this subject. As a result, estimates of these cost burdens are not available at this time.

15. REASONS FOR CHANGE IN BURDEN


There is no change in burden for this information collection. We are making this submission to renew the OMB approval.

  1. REASONS WHY DISPLAYING THE OMB EXPIRATION DATE IS INAPPRO- PRIATE


We believe that displaying the OMB expiration date is inappropriate because it could cause confusion by leading taxpayers to believe that the regulation sunsets as of the expiration date. Taxpayers are not likely to be aware that the Service intends to request renewal of the OMB approval and obtain a new expiration date before the old one expires.
