The E-Government Act of 2002 defines these terms by reference to the definition sections of Titles 40 and
44 of the United States Code. The following is a summary of those definitions:
•“Information Technology” means any equipment or interconnected system or subsystem of
equipment, used in the automatic acquisition, storage, manipulation, management, movement,
control, display, switching, interchange, transmission, or reception of data or information. See 40
U.S.C. § 11101(6).
•“Information System” means a discrete set of information resources organized for the collection,
processing, maintenance, use, sharing, dissemination, or disposition of information. See: 44. U.S.C. §
3502(8).
Note: for purposes of this form, there is no distinction made between national security systems or
technologies/systems managed by contractors. All technologies/systems should be initially reviewed for
potential privacy impact.

SPECIFIC QUESTIONS
1.

Describe the project and its purpose:
Form I-361 is to be filed in support of Form I-360, Petition to Classify Public Law 97-359
Amerasian as the Child, Son, or Daughter of a United States Citizen. Public Law 97-359 (Act
of 10/22/82) provides for the immigration to the United States of certain Amerasian children.
In order to qualify for benefits under this law, an alien must have been born in Cambodia,
Korea, Laos, Thailand, or Vietnam after December 31, 1950, and before October 22, 1982, and
have been fathered by a U.S. citizen. Form I-361 is filed as an agreement to provide financial
support for a five year period for an Amerasian or to petition a court for legal custody of an
Amerasian under 18 years of age. The petitioner must swear to, or affirm the affidavit before
an officer of USCIS if he is in the United States, or a U.S. immigration or consular officer if
outside of the U.S.

Paperwork Reduction Act, which is set to expire on April 30, 2012. The form is being

Form I-361 collects the following data elements from the individual filing the affidavit:
names, addresses, date, city, and country of birth, citizenship or naturalization number, Alien
Number (A-Number), annual income, savings, personal property worth, names of
dependents, age of dependents, names of previously submitted visa beneficiaries, employer,
employer's address beneficiary's name, date of birth, A-Number, address.
