The proposed regulations provide for additional disclosure requirements, due diligence requirements, provide new administrative forbearances, as well as changes to income-based repayment plans.

The proposed regulations streamline the current total and permanent disability (TPD) discharge process. Currently, if a borrower has multiple lenders, a TPD application for each lender/holder must be completed and submitted. Under the proposed regulations, a holder would refer the borrower requesting this type of discharge to the Department, who would then contact all the holders so that collection efforts would be suspended for a period of time to allow the borrower to obtain, complete, and submit the TPD application.
