The Federal Family Educational Loan Program proposed regulations revise current regulations in areas of program administration and assure the Secretary that program integrity is protected from fraud and misuse of program funds. The proposed regulations provide for additional disclosure requirements, due diligence requirements, provide new administrative forbearances, as well as changes to income-based repayment plans.

The proposed regulations streamline the current total and permanent disability (TPD) discharge process. Currently, if a borrower has multiple lenders, a TPD application for each lender/holder must be completed and submitted. Under the proposed regulations, a holder would refer the borrower requesting this type of discharge to the Department, who would then contact all the holders so that collection efforts would be suspended for a period of time to allow the borrower to obtain, complete, and submit the TPD application.
