20__ AEB Exemption Information

he annual process of renewing American Egg Board exemptions is underway. As most of you know, any producer who has an aggregate of less than ________ birds is exempt from paying the AEB assessment. Handlers may also file for exemption if they purchase from exempt producers exclusively and if those producers have filed exemption forms. Handlers should forward exemption forms to appropriate producers. Producers must sign these forms. Do not sign them on their behalf! Anyone who wishes to file for an exemption should note the following:


  1. Exemption status must be renewed annually.


  1. Producers must include the name of the handler to whom they’re selling eggs.


  1. Exemptions are not automatic. No handler should stop deducting the AEB assessment from a producer who’s at the exemption limit unless an exemption certificate is on file. Otherwise, you’ll have to go back to collect from the producer.


  1. A contract producer is not eligible for exemption because the birds are owned by someone else. The producer who owns the layers would be eligible if that individual has a total of ____________ or fewer birds.


  1. Exemption forms must be returned to AEB by ______________ otherwise previously exempt accounts will be reactivated.


  1. Producers and producer/handlers are required to notify AEB if their flock size grows above the exemption level if they’ve already filed an exemption form.


Be sure to complete the statistical information portion of the form regarding flock size and recent number of cases produced to substantiate your exemption eligibility. Incomplete forms will be returned. This means producers should fill in the name of their handler. Also, layer numbers that are not in line with cases reported recently to AEB will result in a challenge to the exemption request.


You may refer to the recently-mailed Question and Answers brochure for more information.


Even if you are a producer or handler who is eligible for exemption, you may continue to pay the assessment voluntarily. Many producers continue to pay the assessment because they view AEB’s advertising, research and promotional efforts as benefits to the entire industry. You must notify AEB if your layer numbers go above the exemption limit

Important Notice: Each handler receiving such certification form shall within 30 days forward a copy to: American Egg Board, 1460 Renaissance Drive, Park Ridge, IL 60068. If the exempt producer becomes subject to assessment pursuant to section 1250.14 of the Rules and Regulations, he shall notify all handlers with whom he has filed a certificate of exemption during the past 12 months.

This form must be filed at the time of initial registration and annually thereafter as long as you, the handler, continue to purchase and/or handle eggs only from exempt producers as described in section 1250.514 of the rules and regulations implementing the Egg Research

and Promotion Order.


ATTN: Producers…

This form also serves as a certification form that shall be filed with each handler within 10 days after the first sale of eggs to such

handler after August 1, 1976 and annually thereafter on or before January 1, as long as the producer continues to do business.



Who is exempt? You must comply with one of these options: (Check one)


I handle eggs only from producers with 75,000 layers or less. (Exemptions from those producers must be

submitted with your form).


I am a combined producer/handler. I have 75,000 birds or less and I process only my own eggs.


I am a producer only (I do not wash, grade or carton eggs). My aggregate number of laying hens at any time during the three consecutive-month period immediately prior to the month in which assessments are due and payable has not exceeded 75,000 laying hens. (Note: You must state below to whom you’re selling eggs.)


I am a producer claiming exemption because my eggs are from a flock of breeding hens, whose egg production

is primarily utilized for the hatching of baby chicks.
