Under the new bankruptcy Act, Pub.L. 109-8, the United States Trustee is charged with creating an approved list of debt education course providers. Each course provider must meet minimum qualifications established by Congress in the new law. The UST needs the information in the application in order to evaluate whether the applicants meet these qualifications established by Congress. The respondents to the application will be debt education providers who will educate individuals regarding personal finances after they file for bankruptcy.

The time burden associated with completing renewal applications for approval as credit counseling agencies or debtor education providers has decreased due to non-substantive changes to the application form. Whereas the application form previously requested that applicants provide complete answers to each question, even when unchanged from previous application periods, the revised application form permits returning applicants to state whether their answers to application questions have changed. If not, the applicant need only mark a "no change" (NC) box with respect to those questions. Dispensing with the need to provide complete responses and supporting documentation may reduce the burden on returning applicants by up to 80 percent.
