Part 101 rules require respondents to
report or disclose information to the Commission or third parties,
respectively, and to maintain records. These requirements are
necessary for the Commission staff to carry out its duties to
determine technical, legal and other qualifications of applicants
to operate and remain licensed to operate a station(s) in the
common carrier and/or private fixed microwave services. In
addition, the information is used to determine whether the public
interest, convenience, and necessity are being served as required
by 47 U.S.C. Section 309 and to ensure that applicants and
licensees comply with ownership and transfer restrictions imposed
by 47 U.S.C. Section 310. The Commission is revising this IC for a
new requirement adopted in FCC 12-87, Backhaul Second Report &
Order. The Rural Microwave Flexibility Policy directs the FCC's
Wireless Telecommunications Bureau to favorably consider waivers of
the payload capacity requirements if Fixed Service (FS) applicants
demonstrate compliance with certain criteria.

The Commission is reporting a
program change increase in hours and costs due to a revision
because of adoption of FCC 12-87. This final rule increase the
total annual burden by 200 hours; increased the number of responses
by 50 responses; and increased the annual costs by $50,000. This
increase will allow FS operators to comply with the Rural Microwave
Flexibility Policy adopted in the Backhaul Second Report and Order,
FCC 12-87.
