ONRR proposes new regulations in title
30 CFR to implement the provisions of the Energy Policy Act of 2005
(EPAct) governing the payment of advance royalty on coal resources
produced from Federal leases. The EPAct provisions amend the
Mineral Leasing Act of 1920. ONRR also proposes to add information
collection requirements that are applicable to all solid minerals
leases and also are necessary to implement the EPAct Federal coal
advance royalty provisions. ONRR would use the collected
information to ensure that royalties are reported timely and paid
appropriately and are based on correct product valuation. ONRR, as
well as other Federal Government, State, and Tribal entities, would
use the collected information for audit purposes and for evaluation
of the reasonableness of product valuation or of allowance claims
submitted by lessees. Failure to collect such data would prevent
the Secretary from accomplishing statutory and trust
responsibilities.
There is a "Program Change" net
increase due to (1) the reallocation decrease of burden hours from
the Solid Minerals Production and Reporting IC (Form MMS-4430) plus
(2) the increase of additional burden hours to the proposed Form
ONRR-4440, Solid Minerals Sales Summary, related to the revision of
title 30 CFR 1210.202(a).
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
The following is a summary of the topics, regarding
the proposed collection of information, that the certification
covers:
(i) Why the information is being collected;
(ii) Use of information;
(iii) Burden estimate;
(iv) Nature of response (voluntary, required for a
benefit, or mandatory);
(v) Nature and extent of confidentiality; and
(vi) Need to display currently valid OMB control
number;
If you are unable to certify compliance with any of
