SUPPORTING STATEMENT

(Revenue Procedure 2012-1)



  1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION


This revenue procedure permits taxpayers to submit ruling requests involving one or more issues regarding the tax consequences or characterization of a transaction (or part of a transaction) that occurs in the context of a distribution under § 355 of the Internal Revenue Code without the taxpayer’s having to request a ruling on the entire transaction, as currently required.


This revenue procedure explains how the Service provides advice to taxpayers on issues under the jurisdiction of the Associate Chief Counsel (Corporate), the Associate Chief Counsel (Financial Institutions and Products), the Associate Chief Counsel (Income Tax and Accounting), the Associate Chief Counsel (International), the Associate Chief Counsel (Passthroughs and Special Industries), the Associate Chief Counsel (Procedure and Administration), and the Division Counsel/Associate Chief Counsel (Tax Exempt and Government Entities). It explains the forms of advice and the manner in which advice is requested by taxpayers and provided by the Service.


  1. USE OF DATA


This data will be used in the same manner that the existing data collection is used. It will be used by the Service in determining whether certain letter rulings should be issued.

We have no plans at this time to offer electronic filing because electronic filing is not appropriate for the collection of information in this submission.

This Office has discussed this revenue procedure at various bar panels and it is not believed that there will be any substantial increased burden.


In response to the Federal Register Notice dated June 11, 2012 (77 FR 34459), we received no comments during the comment period regarding RP 2012-1.

Generally, tax returns and tax return information are confidential as required by 26 USC 6103.

  1. ESTIMATED BURDEN OF INFORMATION COLLECTION


The collections of information in this revenue procedure are in sections 5.06, 6.03, 7.01, 7.02, 7.03, 7.04, 7.05, 7.07, 8.02. 8.05, 8.07, 10.01, 10.06, 10.07, 11.11, 13.02, 15.02, 15.07, 15.08, 15.09, 15.11, paragraph (B)(1) of Appendix A, Appendix C, and Appendix E (subject matter—rate orders; regulatory agency; normalization). This information is required to evaluate and process the request for a letter ruling or determination letter. In addition, this information will be used to help the Service delete certain information from the text of the letter ruling or determination letter before it is made available for public inspection as required by § 6110. The collections of information are required to obtain a letter ruling or determination letter. The likely respondents are businesses or other for-profit institutions.


The estimated total annual reporting and/or recordkeeping burden is 305,540 hours.


The estimated annual burden per respondent/recordkeeper varies from 1 to 200 hours, depending on individual circumstances, with an estimated average burden of 80 hours.

The estimated number of respondents and/or recordkeepers is 3,825.

Estimates of the annualized cost to respondents for the hour burdens shown are not available at this time. Whatever the burden is under this procedure, it will be substantially less than the burden under existing procedures.


  1. ESTIMATED TOTAL ANNUAL COST BURDEN TO RESPONDENTS


As suggested by OMB, our Federal Register Notice dated June 11, 2012 (77 FR 34459), requested public comments on estimates of cost burden that are not captured in the estimates of burden hours, i.e., estimates of capital or start-up costs and costs of operation, maintenance, and purchase of services to provide information. However, we did not receive any response from taxpayers on this subject. As a result, estimates of the cost burdens are not available at this time.


  1. ESTIMATED ANNUALIZED COST TO THE FEDERAL GOVERNMENT


Not applicable.


  1. REASONS FOR CHANGE IN BURDEN


There is no change in the paperwork burden previously approved by OMB. This submission is being made to renew the OMB approval.

Not applicable.


  1. REASONS WHY DISPLAYING THE OMB EXPIRATION DATE IS INAPPROPRIATE


We believe that displaying the OMB expiration date is inappropriate because it could cause confusion by leading taxpayers to believe that the regulation sunsets as of the expiration date. Taxpayers are not likely to be aware that the Service intends to request renewal of the OMB approval and obtain a new expiration date before the old one expires.
