Under the
Affordable Care Act (ACA, pre-existing condition exclusions will be
prohibited in all health insurance plans starting January 1, 2014.
In light of this prohibition, OMB recommends that IRS reevaluate
and revise this information collection as needed, and resubmit this
collection for OMB review and approval. If the collection is no
longer necessary, as a result of this ACA prohibition, we
recommmend IRS discontinue the collection.

The regulations provide guidance for
group health plans and the employers maintaining them regarding
requirements imposed on plans relating to preexisting condition
exclusions, discrimination based on health status, and access to
coverage.
