Response: No changes were required.

Question 14. Status at Last Entry (B2, F1, J1, No lawful status, etc.)

Comment: A commenter recommended that USCIS change Question 14 parenthetical to “B-2 Visitor, F-1 Student, J-1 Exchange Visitor, No lawful status, etc.” because many applicants may not be familiar with alphanumeric visa categories.


Response: USCIS has agreed to adopt the recommendation.

Section “Who May File Form I-765?”/ 8.E Deferred Action--(c)(14) and 8.F. Consideration of Deferred Action for Childhood Arrivals--(c)(33)

Comment: Commenters recommended that instructions to 8.e. Deferred Action—(c)(14) and 8.F. Consideration of Deferred Action for Childhood Arrivals--(c)(33) be revised to indicate that USCIS will consider whether customers have an economic need to work by reviewing their annual income, annual expenses, and total current value of their assets.


Response: USCIS has agreed to adopt the recommendation.

Section “How To Fill Out Form I-765”/ 3. Answer all questions fully and accurately. If an item is not applicable or the answer is “none,” leave the space blank.

Comment: A commenter recommended that part 3 of Section “How To Fill Out Form I-765” be modified to instruct customers to answer “N/A” or “None” to ensure they have read and answered each and every question of the form and avoid unnecessary requests for further evidence.

Response: USCIS has agreed to adopt the recommendation.
