10 CFR Part 40 establishes
requirements for licenses for the receipt, possession, use and
transfer of radioactive source and byproduct material. The
application, reporting and recordkeeping requirements are necessary
to permit the NRC to make a determination on whether the
possession, use, and transfer of source and byproduct material is
in conformance with the Commission's regulations for protection of
public health and safety.
The overall burden has
decreased by 54,312 from 65,418 to 11,106 hours. These reductions
are due to the implementation of a new data collection procedure
that serves to re-baseline the information collection data of 10
CFR Part 40. It also refines the numbers of the current NRC and
Agreement States licensees, while reducing the ambiguity in data
presentations. The new data collection procedure requires all
program managers in 10 CFR Part 40 (uranium recovery, uranium
decommissioning, fuel cycle facility, and source materials
programs), to submit updated information of their NRC licensee
universe, requirements applicable to their licensees, and burden
hours associated with reporting and recordkeeping for those
requirements, to the information collection project manager; thus
increases the accuracy of the collected information. This is in
contrast to the previous procedure where the information collection
project manager had to rely on the research of outdated documents,
to make projections on the number of NRC and Agreement States
licensees for the information collection renewal period, which are
often based on judgment calls. Because of this new data collection
procedure, the total number of NRC licensees was more refined and
resulted in a reduction from 68 to 51 licensees. The refinement in
the number of NRC licensees in 10 CFR Part 40 programs further
resulted in a more accurate and reduction in the number of
Agreement States licensees, from 272 to 149 licensees. In the
previous data collection procedure, to estimate the number
Agreement States licensees, the information collection project
manager multiplied the number of estimated NRC licensees for all
programs (i.e., 72) by a factor of 4, which resulted in 288
Agreement States licensees. With the new data collection procedure,
three of the 10 CFR Part 40 programs (uranium recovery, uranium
decommissioning, and fuel cycle facility) know that there are
exactly 20 Agreement States licensees among them (12, 8, and 0,
respectively). Because of the unavailable information on the number
of Agreement States licensees associated with the remaining program
(source materials), the information collection project manager
multiplied the number of estimated NRC licensees of this program
(i.e., 28) by a factor of 4.6, which resulted in 129 licensees,
totaling 149 Agreement States licensees for all four programs.
Along with the refinement and reduction in the numbers of NRC and
Agreement States licensees, further reduction in burden is
attributed to the new data collection procedure which requires all
program managers in 10 CFR Part 40 to update information on the
requirements applicable to their licensees and burden hours
associated with reporting and recordkeeping for those requirements.
The updated information show a reduction in the numbers of
respondents, from previously reported 340 to the current 99
respondents, and the total number of responses per respondents,
from previously reported 894 to the current 589 responses. Thus,
the reduction in total number of respondents and total number of
responses translates into reduction of total burden hours, from
previously reported 65,418 hours to the current 11,106 hours. In
addition, there was a change in the overall cost due to an increase
in the hourly fee rate from $238/hr to $274/hr.
