We (U.S. Fish and Wildlife Service) are amending the regulations at 50 CFR 22 to provide for terms of up to 30 years for programmatic permits for nonpurposeful take of golden eagles and bald eagles where the take is associated with, but not the purpose of, the activity. Permits for periods longer than 5 years would be available only to applicants who commit to implementing such adaptive measures if monitoring shows that the measures are both needed and likely to be effective. Any such required "adaptive management measures" would be negotiated with the permittee and specified in the terms and conditions of the permit. We will use the information collected on eagle take permit applications to: (1) evaluate applications, (2) issue or deny permits based on the evaluation criteria in 50 CFR 22.26(e), and (3) assess the potential cumulative impacts of such permits for purposes of adaptive management. We will use the information from the reports to: (1) determine if the conservation strategies are reaching the intended biological goals, (2) develop improved management strategies for covered species, and (3) evaluate the success of the permit program.
