OMB is approving the current request for reinstatement of SBA’s 8(a) Annual Update (OMB Control Number 3245-0205) for a three-year period. Before this information collection is resubmitted to OMB for another three-year approval, the Agency must ensure that the personnel responsible for collecting, using, and monitoring this information collection have received training on compliance with the Paperwork Reduction Act (PRA) requirements and further, that such personnel are provided a detailed plan for ensuring those requirements are met in a timely manner to prevent future violations of the PRA. Details of this plan must be included in the Supporting Statement with the next request for approval of this information collection. If SBA fails to resubmit this information collection for approval before it expires, the Agency’s request for reinstatement must include a reasonable written explanation for missing the expiration deadline. Failure to provide this justification may be basis for disapproval of the information collection. SBA complied with the terms of the prior clearance for this IC. An FR notice was published on 02/28/2013 outlining the proposed changes and providing the public with an additional 30 days to comment on those changes. The controversial Attachment C re the report on tribal benefits, which had been submitted with the ICR previously, was removed and is currently drafted as a separate ICR. A separate FR notice was also published on 2/8/2013 for this IC.

In accordance with Title 13 of the Code of Federal Regulations, Section 124.403, each 8(a)participant must annually review its business plan with the assigned Business Opportunity Specialist (BOS) and modify the plan, as appropriate, within 30 days after the close of each program year. The Participant must also submit a statement describing its current contract performance capabilities as part of its update business plan. SBA uses the information collected to assess the participant's financial condition and continued eligibility.
