The Commission is submitting this proposed rulemaking for the Advanced Wireless Services (AWS) H Block to make available ten megahertz of spectrum for flexile use, extending the current Personal Communications Services (PCS) band, which is used by the four national providers as well as regional and rural providers to offer mobile service across the Nation. The NPRM begins the implementation of the Congressional directive in the Middle Class Tax Relief and Job Creation Act of 2012 (Spectrum Act) to grant new initial licenses for the 1915-1920 MHz (Lower H Block) and 1995-2000 MHz (Upper H Block) bands through a system of competitive bidding - unless doing so would cause harmful interference to commercial mobile service licensees in the 1930-1995 MHz (PCS downlink) band. The Commission is now submitting this collection as a revision (even though ROCIS will not allow this selection above) because the final rules adopted in the NPRM that was approved on 3/13/13 are modified. The OMB desk officer instructed the Commission to submit this collection when the OMB action was "file with comment" on the NPRM. No 30 day notice is required, per the OMB desk officer.

The Commission is not requesting a new OMB control number for this approved NPRM. It was give OMB control number 3060-1184 at the proposed rule stage. The NOA issued on 3/13/12013 stated that the FCC would resubmit at the final rule stage. We are now doing so. The FCC 13-88 Report and Order modified this collection but in the above caption Type of Information Collection, ROCIS will not allow a "revision" in the drop down window. (Also please note OMB Control Number 3060-1184 at the top of this screen.) There is no change in the Commission's previous burden estimates which are miniminal (14 hours total annual burden).
