  1. CIRCUMSTANCES NECESSITATING COLLECTION OF INFORMATION


Section 7502(a) of the Internal Revenue Code provides that a document received after the due date for filing will be treated as filed on the date of the United States postmark on the envelope containing the document if the postmark date is on or before the date for filing the document and the document is placed in the U.S. mail on or before the due date (“Timely mailing treated as timely filing rule”). Section 7502(c) provides if a taxpayer uses registered or certified mail, the date of the postmark on the sender’s receipt will be treated as the postmark date and will constitute prima facie evidence that the document was delivered to the Service. The proposed regulations provide that, absent actual delivery, the registered or certified mail receipt will be the only acceptable evidence that the document was delivered to the Service.


  1. USE OF DATA


The collection of information is necessary in order for taxpayers to be able to establish the postmark date and prima facie evidence of delivery when using registered or certified mail.


  1. USE OF IMPROVED INFORMATION TECHNOLOGY TO REDUCE BURDEN


We have no plans to offer electronic filing. IRS Publications, Regulations, Notices and Letters are to be electronically enabled on an as practicable basis in accordance with the IRS Reform and Restructuring Act of 1998.


  1. EFFORTS TO IDENTIFY DUPLICATION


We have attempted to eliminate duplication within the agency wherever possible.

A notice of proposed rulemaking was published in the Federal Register on September 21, 2004 (69 FR 56377).


We received no comments during the comment period in response to the Federal Register notice dated June 18, 2013 (78 FR 36639).

  1. ASSURANCE OF CONFIDENTIALITY OF RESPONSES


Generally, tax returns and tax return information are confidential as required by 26 U.S.C. 6103.


  1. JUSTIFICATION OF SENSITIVE QUESTIONS


Information collected may be in one of two systems.


A privacy impact assessment (PIA) has been conducted for information collected under this request as part of the “Business Master File (BMF)” system and a Privacy Act System of Records Notice (SORN) has been issued for this system under IRS 24.046-Customer Account Data Engine Business Master File. The Department of Treasury PIAs can be found at http://www.treasury.gov/privacy/PIAs/Pages/default.aspx.


A PIA has also been conducted for information collected under this request as part of the “Individual Master File (IMF)” system and a Privacy Act System of Records Notice (SORN) has been issued for this system under IRS 24.030--Customer Account Data Engine Individual Master File, formerly Individual Master File, and IRS 34.037--IRS Audit Trail and Security Records System.


Title 26 USC 6109 requires inclusion of identifying numbers in returns, statements, or other documents for securing proper identification of persons required to make such returns, statements, or documents and is the authority for social security numbers (SSNs) in IRS systems.

As suggested by OMB, our Federal Register notice, dated June 18, 2013, requested public comments on estimates of burden that are not captured in estimates of burden hours, i.e., estimates of capital or start-up costs and costs of operation, maintenance, and purchase of services to provide information. However, we did not receive any response from taxpayers on this subject. As a result, estimates of the cost burdens are not available at this time.

  1. REASONS FOR CHANGE IN BURDEN


There is no change in the paperwork burden previously approved by OMB. We are making this submission to renew the approval.

  1. REASONS WHY DISPLAYING THE OMB EXPIRATION DATE IS INAPPROPRIATE


We believe that displaying the OMB expiration date is inappropriate because it could cause confusion by leading taxpayers to believe that the regulations sunset as of the expiration date. Taxpayers are not likely to be aware that the Service intends to request renewal of the OMB approval and obtain a new expiration date before the old one expires.
