National Marine Fisheries Service (NMFS) would issue this regulation under the Tuna Conventions Act to implement a resolution adopted by the Inter-American Tropical Tuna Commission (IATTC) in June 2004. This rule implements IATTC Resolution C-04-06 intended to require owners and operators of tuna-fishing vessels to have installed, activate, carry and operate vessel monitoring system (VMS) units (also known as "mobile transmitting units"). This regulation would apply to owners and operators of commercial vessels, 24 meters or more in length, targeting tuna and operating in the IATTC Convention Area (area bounded by the coast of the Americas, the 50° N. and 50° S. parallels, and the 150° W. meridian in the eastern Pacific Ocean). The VMS units would have to be type-approved and authorize NMFS to receive and relay transmissions (also called "position reports") from the VMS unit to the IATTC and to NMFS. The proposed action is necessary for the United States (U.S.) to satisfy its international obligations under the 1949 Convention for the Establishment of an Inter-American Tropical Tuna, to which it is a Contracting Party.
