Justification for Non-Substantive Change

License Exceptions and Exclusions

OMB Control Number: 0694-0137



This non-substantive change is needed to support publication of a proposed rule “Proposed Revisions to the Export Administration Regulations (EAR): Unverified List (UVL)” (RIN 0694-AF70).

The rule changes this information collection by suspending the availability of license exceptions for exports, reexports, and transfers (in-country) to persons listed on the UVL. A license exception is when someone can ship an item that would normally require a license, under license exception, if certain conditions are met.

It is estimated that this change to suspend license exceptions will decrease the burden in OMB Control No. 0694-0137 by 18 license exceptions per year. The license exceptions affected by RIN 0694-AF70 are:

  1. Approximately 80% - Encryption Commodities and Software and Technology, which carries an estimated burden of 10 minutes.

  1. Remaining 20% - Shipments to Country Group B Countries, Civil End-Users, and other license exceptions that carry an estimated burden of 5 minutes.

Therefore, the estimated decrease to OMB Control No. 0694-0137 is 14 x 10 minutes + 4 x 5 minutes =

3 hours annually.
