Pursuant to the authority contained in
Section 512 of the Employee Retirement
Income Security Act of 1974 (ERISA), 29
U.S.C. 1142, the 170th open meeting of
the Advisory Council on Employee
Welfare and Pension Benefit Plans (also
known as the ERISA Advisory Council)
will be held on March 26, 2014.
The meeting will take place in Room
S–2508, U.S. Department of Labor, 200
Constitution Avenue NW., Washington,
DC 20210. The purpose of the open
meeting, which will run from 1:30 p.m.
to approximately 4:30 p.m. Eastern
Standard Time, is to welcome the new
members, introduce the Council Chair
and Vice Chair, receive an update from
the Assistant Secretary of Labor for the
Employee Benefits Security
Administration, and determine the
topics to be addressed by the Council in

AGENCY:

The Department of Labor, as
part of its continuing effort to reduce
paperwork and respondent burden,
conducts a preclearance consultation
program to provide the general public
and Federal agencies with an
opportunity to comment on proposed
and/or continuing collections of
information in accordance with the
Paperwork Reduction Act of 1995
(PRA95). 44 U.S.C. 3056(c)(2)(A). This
program helps to ensure that requested
data can be provided in the desired
format, reporting burden (time and
financial resources) is minimized,
collection instruments are clearly
understood, and the impact of collection
requirements on respondents can be
properly assessed. Currently, the Wage
and Hour Division is soliciting
comments concerning its proposal to
extend Office of Management and
Budget (OMB) approval of the
Information Collection: Housing

I. Background
The Wage and Hour Division (WHD)
of the Department of Labor (DOL)
administers the Migrant and Seasonal
Agricultural Worker Protection Act
(MSPA), 29 U.S.C. 1801 et seq. The
MSPA protects migrant and seasonal
agricultural workers by establishing
employment standards related to wages,
housing, transportation, disclosures,
and recordkeeping. The MSPA also
requires farm labor contractors and farm
labor contractor employees to register
with the U.S. Department of Labor and
to obtain special authorization before
housing, transporting, or driving
covered workers. The MSPA requires
that any person owning or controlling
any facility or real property to be used
for housing migrant agricultural workers
shall not permit such housing to be
occupied by any worker unless copy of
a certificate of occupancy from the state,
local or federal agency that conducted
the housing safety and health inspection
is posted at the site of the facility or real
property. The certificate attests that the
facility or real property meets applicable
safety and health standards. Form WH–
520 is an information gathering form
and the certificate of occupancy that the
Wage and Hour Division issues when it

is the federal agency conducting the
safety and health inspection.
