The Federal Railroad Administration and the railroad industry use the information to determine the extent of alcohol and drug abuse on railroad property as well as to curtail widespread alcohol and drug use. Under this proposed rule which responds to an RSIA Congressional mandate, FRA is proposing to expand the scope of its alcohol and drug regulations to cover employees who perform maintenance-of-way (MOW) activities. Additionally, FRA is proposing certain substantive amendments that either respond to National Transportation Safety Board (NTSB) recommendations or update and clarify the alcohol and drug regulations based on a retrospective regulatory review (RRR) analysis.

The burden for this collection of information has decreased by 10,507 hours from the last submission. The decrease in burden is due both to program changes and adjustments. The two tables provided in the answer to question number 15 of the Supporting Justification fully itemize both the program changes and adjustments. Program changes decreased the burden amount by 22,969 hours, and increased the number of responses by 47,076. Adjustments increased the burden amount by 12,462 hours, and increased the number of responses by 120,655. The current inventory shows a burden total of 31,797 hours, while the present submission exhibits a burden total of 21,290 hours. Hence, there is a burden decrease of 10,507 hours. Total cost to respondents under the proposed rule amounts to/has increased by $1,466,175 from the last submission. This is a program change entirely associated with the requirements of this proposed rule pertaining to MOW employeees..
