EPA is finalizing revisions, based in the risk and technology reviews, to the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Flexible Polyurethane Foam Production. Potential respondents subject to the new requirements of the NESHAP include an estimated 12 existing facilities that produce flexible polyurethane foam. The responses attributable to this ICR consist of reports and recordkeeping to assure compliance with 40 CFR part 63, subpart III, as amended. No burden estimates are provided for new sources because no new facilities are expected to be affected sources during the next 3 years. We believe the number of affected facilities under this subpart will remain constant for this source category. The overall change in burden found in this ICR reflects the provision changes and corrections to the number of affected facilities found in EPA ICR number 1783.07. The period considered in this ICR and throughout this supporting statement is the first three years following the promulgation of the amendments to the Flexible Polyurethane Foam Production NESHAP.

This is a revised data collection due to amendments to the rule. The overall estimated burden has decreased due to the elimination of prior existing burden items related to hazardous air pollutant emissions from auxiliary blowing agents. Those burden items have been replaced with a recordkeeping requirement only. Also, there are fewer major source facilities in the source category than previously estimated has led to a further decrease in burden.
