Fast Track Appeals Notices: NOMNC/DENC

The comments received on this collection involved including additional information in the instructions for particular discharge situations as well as representation during an appeal. The commenter also inquired about the mail type required after telephone delivery of a notice.
When specified, such as initial delivery to representatives, notice delivery may require some type of tracked mail. However, we do not prescribe the mail delivery method in all circumstances. If not specified, providers may use whatever delivery method they consider appropriate.
Due to the nature and space limitations of notice instructions, all possible discharge and notice delivery situations cannot be specified.
We have provider and Health Plan manuals which discuss a wider range of discharge situations.
The relevant manual section for Medicare health plan enrollees can be found at Chapter 13, sections 90.2 – 90.11 of the Medicare Managed Care Manual.
Original Medicare instructions for NOMNC delivery can be found at Chapter 30, section 260 of the Medicare Claims Processing Manual.
Instructions on who may represent a beneficiary or enrollee during an appeal can be found at Chapter 29, section 270 of the Medicare Claims Processing Manual and at Chapter 13, section 10.4 of the Medicare Managed Care Manual.
No program/burden revisions or adjustments will be made as a result of these comments.
