Non-substantive Modifications to Information Collection 3060-1157, Formal Complaint Procedures, Preserving the Open Internet and Broadband Industry Practices

The Commission is seeking a non-substantive change request from the Office of Management and Budget (OMB) for this information collection. The burden hours and cost are not impacted by this change request.

8.13 (b)	Modified caption, updated and inserted inadvertently omitted language to reflect fee, filing and service requirements for initial complaints to facilitate e-filing and to be clear and accurate.
8.13 (c)-(e)	Renumbered former rule 8.13 (c) as 8.13 (d), renumbered former rule 8.13 (d) as rule 8.13 (e), and added subpart (c). Rule 8.13 (c) updates the Open Internet formal complaint filing process to facilitate e-filing for subsequent pleadings and to include inadvertently omitted language about service requirements that is needed to be clear and accurate.
8.14 (g)-(i)	Renumbered former rule 8.14 (g) as rule 8.14 (h) and renumbered former rule 8.14 (h) as rule 8.14 (i).
8.14 (g)	Rule 8.14 (g) provides discretion to the Enforcement Bureau to seek written opinions from outside technical organizations during an Open Internet formal complaint proceeding.
8.16 (a)	Sub-sections were added and language modified using parts of former rules 8.16 (a) – 8.16 (b) to be consistent with e-filing procedures for redaction of confidential materials filed as part of an Open Internet formal complaint. Former rule 8.16 (b) was then deleted once subsumed into updated rule 8.16 (a).
8.16 (b)-(f)	Renumbered former rules 8.16 (c) through 8.16 (g) as 8.16 (b) through (f).
8.16 (c)	Added an omitted citation to the statutory standard for making confidentiality requests by means other than electronic filing. This rule part was former rule 8.16 (d).
8.16 (d)	Modified a confidentiality provision of former rule 8.16 (e) now rule 8.16 (d) to exclude Commission staff and court reporters/stenographers who are already bound by confidentiality obligations.
