Report of Stolen or Lost ATF Forms 5400.30, Intrastate Purchase Explosive Coupon


A. Justification


1. Necessity of Information Collection


ATF is charged with the responsibility for enforcing Title XI of the Organized Crime Control Act (the Act) of 1970 and the implementing regulations contained at 27 CFR, Part 555. Subtitle C of Public Law No. 107-296, the Safe Explosives Act, enacted November 25, 2003. The act requires that persons wishing to acquire explosives from a Federal explosives licensee or permittee within their state of residence on no more than 6 occasions per year, must obtain a limited permit from ATF. ATF is distributing 6 copies of ATFE F 5400.30, Intrastate Purchase of Explosives Coupon (IPEC) to each applicant who is issued a limited permit. One coupon will be completed for each transaction in which the limited permittee receives explosive materials. It is anticipated that, on occasion, IPEC forms will be lost or misplaced. This collection of information is being implemented in order to facilitate the replacement of such forms under the provisions of 27 CFR, Section 555.34. This section requires that, upon losing possession of ATF Form 5400.30, a person must immediately report the matter to the Director. The report must detail the circumstances of the theft, loss, or destruction and include all known facts, which may serve to identify the document.


2. Need and Uses


This information will be used by ATF to document and investigate thefts and losses of IPEC forms, and to ensure that limited permittees timely receive replacement forms.


3. Use of Information Technology


The information collection does not use any information technology as the collection only requires the applicant to notify ATF of the loss.


4. Efforts to Identify Duplication


ATF uses a uniform subject classification system to identify duplication and to ensure that any similar information already available cannot be used or modified for use for the purpose of this information collection.


5. Minimizing Burden on Small Businesses


This collection will not substantially affect small businesses.


6. Consequences of Not Conducting or Less Frequent Collection


The consequences of not conducting this information collection would result in ATF not being able to investigate thefts and losses of the form.


7. Special Circumstances


There are no special circumstances associated with this collection.


8. Public Comments and Consultations


ATF consulted with the explosives industry. A 60-day and 30-day Federal Register notice was published in order to solicit comments from the general public. No comments were received.


9. Provision of Payments or Gifts to Respondents


No payment or gift is associated with this collection.


10. Assurance of Confidentiality


The information regarding the theft or loss is communicated by telephoning 1-888-ATF-BOMB (nationwide toll free number). Confidentiality is not assured.


11. Justification for Sensitive Questions


No questions of a sensitive nature are asked.


12. Estimate of Respondent’s Burden


We estimate that there are a total of 10 respondents that will be associated with this information collection request. Each respondent will respond 1 time. Total number of responses is 10. We estimate that each respondent will spend approximately 20 minutes completing the required documentation to report the theft or loss. The total annual burden hours associated with this burden request will be 3.5 hours.


13. Estimate of Cost Burden


There is no cost burden to the respondent.



14. Cost to Federal Government


There is no cost to the Federal government.


15. Reason for Change in Burden


There are adjustments associated with this collection. The number of ATF limited permit holders has decreased dramatically over the past several years. There have been 10 or fewer than 10 holders of the ATF limited permit in the past 3 years. Further, ATF has received no record of an IPEC coupon theft in the past 3 years. Holders of an ATF limited permit are issued sheets of 6 IPEC coupons each. ATF has adjusted the number of respondents based upon an estimate of 10 limited permits issued during the next 3 years, and an estimate of the possible theft or loss of approximately 15% of IPEC coupons associated with those permits.


16. Anticipated Publication Plan and Schedule


The results of this collection will not be published.


17. Display of Expiration Date


ATF does not request approval to not display the expiration date of OMB approval for this collection.


18. Exception to the Certification Statement


There are no exceptions to the certification statement.
