Title: Section 74.751, Modification of Transmission Systems
SUPPORTING STATEMENT
A. Justification
1. 47 CFR Sections 74.751(a) and (c) require licensees of low power TV or TV translator stations to send written notification to the FCC of equipment changes which may be made at licensee's discretion without the use of a formal application.
47 CFR Section 74.751(d) requires that licensees of low power TV or TV translator stations place in the station records a certification that the installation of new or replacement transmitting equipment complies in all respects with the technical requirements of this section and the station authorization.
The Commission is requesting an extension of this submission in order to obtain the full three year clearance from OMB.
This information collection does not affect individuals or households; thus, there are no impacts under the Privacy Act.
Statutory authority for this collection of information is contained in Section 154(i) of the Communications Act of 1934, as amended.
2. The notifications of equipment changes are used by FCC staff to assure that the equipment changes made are in full compliance with the technical requirements of this section and the station authorizations and will not cause interference to other authorized stations. The certification of the installation of new or replacement transmitting equipment serves as a record of the change of equipment.
3. This information collection are simple notification and certification requirements. The use of information technology is not feasible in this situation.
4. No other agency imposes a similar information collection on the respondents. There is no similar data available.
5. This collection does not impose any significant impact on small businesses.
6. The frequency for this collection of information is determined by respondents, as necessary.
7. The retention period for the certification that the installation of new or replacement equipment complies with the technical requirements of this section shall be retained so long as the station is authorized to operate with this equipment.
8. The Commission published a Notice (81 FR 14442) in the Federal Register on March 17, 2016 seeking comment from the public on the information collection requirements contained in this collection. No comments were received from the public as a result of the Notice.
9. No payment or gift was provided to the respondent.
10. There is no need for confidentiality with this information collection.
11. This information collection does not address any private matters of a sensitive nature.
12. We estimate that 200 notifications will be filed and processed. The average burden on licensee is 0.50 hours per notification. We also estimate that 200 certifications will be placed in the station records. The average burden on licensee is 0.50 hours per certification. This estimate is based on FCC staff's knowledge and familiarity with the availability of the data required.
Total Number of Annual Respondents: 400 Licensees
Total Number of Annual Responses: 400 Written Notifications/Certifications
Total Number of Annual Burden Hours:
200 notifications x 0.5 hours per notification/licensee/annum = 100 hours
200 certifications x 0.5 hours per certification/licensee/annum = 100 hours
200 hours
Annual “In-House” Cost: We assume that licensee of the low power TV or TV translator station would prepare the written notification to the FCC and the certification to be placed in the station records. We estimate that this licensee would have an average yearly salary of $100,000 ($48.08/hour).
200 notifications x 0.5 hours/licensee/annum x $48.08/hour = $4,808.00
200 certifications x 0.5 hours/licensee/annum x $48.08/hour = $4,808.00
Total Annual “In-House” Cost: $9,616.00
13. Annual Cost Burden:
Total annualized capital/startup costs: None
Total annual costs (O&M): None
(c) Total annualized cost requested: None
14. Cost to the Federal Government: The Commission will use professionals staff at the GS-12 step 5 grade level ($42.08/hour) and clerical staff at the GS-5 step 5 grade level ($19.15/hour) to process these notifications.
200 notifications x 0.50 hours/notification processing time x $42.08 = $4,208.00
200 notifications x 0.50 hours/notification processing time x $19.15 = $1,915.00
Total Cost to the Federal Government = $6,123.00
15. There are no adjustments or program changes to this information collection.
16. The data will not be published.
17. OMB approval of the expiration date will be displayed at 47 C.F.R. Section 0.408.
18. There are no exceptions to the Certification Statement.
