Justification for Non-material Changes to TTB F 5100.31

Abstract:


To provide consumers with adequate information as to the identity of alcohol beverage products and to prevent consumer deception and unfair advertising practices, the Federal Alcohol Administration Act at 27 U.S.C. 205(e) requires that alcohol beverages sold or introduced into interstate or foreign commerce be labeled in conformity with regulations issued by the Secretary of the Treasury. Under this authority, the producer, bottler, or importer of an alcohol beverage must receive approval of the label for the product from the Alcohol and Tobacco Tax and Trade Bureau (TTB) prior to the product’s introduction into United States commerce. Respondents use TTB F 5100.31 to request and to obtain the required label approval. The form serves as both an application for and, if approved by TTB, a certificate of label approval (COLA), or as exemption from a certificate of label approval.


Changes and Justification


TTB is requesting four non-material changes to this information collection. TTB will be remove the following data fields from TTB F 5100.31 and its online equivalent, COLAs Online:


  1. Net Contents (data field # 12 on the current paper form);

  2. Alcohol Content (data field # 13 on the current paper form);

  3. Wine Vintage Date (data field # 15 on the current paper form);

  4. Fax Number (data field # 17 on the current paper form).


In addition, the instructions for these four data fields will be removed from the form and COLAs Online.


TTB no longer requires the information collected in these four data fields. Net contents, alcohol content, and wine vintage date are no longer required data fields because these items may be changed on an alcohol beverage label without prior TTB approval (known as “allowable revisions;” see Part V of TTB F 5100.31). TTB is removing the Fax number data field because we no longer communicate with respondents to this information collection via Fax.


We do not believe that the removal of these four data fields will appreciably effect the burden associated with this information collection. We are, therefore, continuing to state in the form’s Paperwork Reduction notice that a respondent requires 31 minutes to complete this information collection.
