The U.S. Fish and Wildlife Service (Service) is charged with implementing the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.) (Act). The purposes of the Act are to provide a means whereby the ecosystems upon which listed species depend may be conserved and to provide a program for listed species conservation. The Service is proposing a new policy to implement recent Executive Office and Department of the Interior mitigation policies that necessitate a shift from project-by-project to landscape scale approaches to planning and implementing compensatory mitigation. This new policy will improve the consistency in the use of compensatory mitigation as recommended or required under the Endangered Species Act. If adopted, this policy would cover permittee-responsible mitigation, conservation banking, in lieu fee programs, and other third-party mitigation mechanisms. It would also stress the need to hold all compensatory mitigation mechanisms to equivalent standards.

This is a new collection. The standards and minimum criteria for review and approval of compensatory mitigation set forth in the Service's draft compensatory mitigation policy involve information collection in the form of compensatory mitigation proposals, instruments, and management and monitoring reports for established compensatory mitigation programs, projects, and measures.
