Effective Rate Review Survey Instructions
The purpose of the Effective Rate Review (ERR) Survey is to collect information on an annual basis for CMS to determine whether states are maintaining their Effective Rate Review Programs, pursuant to the authority set forth in 45 CFR §154.301(d). Not only will this information provide insights into the rate review process in each state, but it will identify areas where CMS may support states through additional clarification of market reforms. Survey responses should identify the source(s) of a state’s authority to review rates and describe a state’s review process including how it meets the federal requirements.
Please complete the Effective Rate Review Survey and submit it to CMS via the Health Insurance Oversight System (HIOS) State Document Collection (SDC) Module no later than XX XX, 2016. Please note that:
The Effective Rate Review Survey is labeled as the Rate Review Annual State Report within the HIOS SDC Module.
All questions in Parts I and II are required and should be answered for the 2018 plan year.
All questions in Part III are optional and should be answered for the previous calendar year.
Upon receipt of the survey responses, CMS will determine whether additional follow up is needed in order to renew a specific state’s status as an Effective Rate Review Program state.
