Pursuant to the Magnuson-Stevens Fishery Conservation and Management Act; Seafood Import Monitoring Program (SIMP), this proposed rule would require the online application and submission of an internal control plan from entities wishing to become trusted traders, and would modify the filing and recordkeeping procedures relating to the importation of certain fish and fish products, in order to implement the SIMP’s prohibition on the entry into U.S. commerce of fish taken, possessed, transported or sold in violation of any foreign law or regulation. The information required under SIMP would not need to be filed at the time of entry, but must be available within two weeks from request by NMFS, thereby reducing the burden of reporting and recordkeeping required by the SIMP. This proposed rule stipulates the catch and landing data for imports of certain fish and fish products which would be required, the requirements for recordkeeping concerning such imports, the necessity of a written trusted trader / internal control plan, and the requirement of third-party auditing to validate the internal control system of the voluntary participant.
