Justification for Instructions Portions (Appendix B) of Forms WB-APP and TCR

Revisions are made to the submission instructions portions of forms WB-APP and TCR to conform to revisions in the Part 165 Whistleblower Rules.  Principally, the Commission removed question E.8 on Form TCR as it was not consistent with the authority granted to the Commission to share whistleblower identifying information in Section 23(h)(C)(i) of the Commodity Exchange Act and Rule 165.4(a)(2).  The Privacy Act Notice in Form TCR puts potential whistleblowers on notice that the information that they provide to the Commission may be shared with other authorities.
