An employer selling assets of a
business covered by a multiemployer pension plan may have liability
to the plan unless certain statutory rules are followed. The
selling and buying empoyers may submit information prescribed by
this regulation to PBGC or the plan with a request for a waiver of
those rules. The information is needed to determine whether a
waiver is appropriate.
The hour burden increased from
2.75 hours to 1,050 hours and the cost burden increased from $1,297
to $501,000. The increase in hour and cost burden is due to an
increase in the number of estimated respondents and a change in
methodology for estimating the cost and hour burden.
