Justification of Non-Substantive Changes to Collection 3060-0056


The Commission is submitting this non-substantive change request to the Office of Management and Budget (OMB) to amend the Commission’s rules to apply the complaint procedures for legacy wireline telephones to wireline telephones used to connect to advanced communications services (ACS telephonic CPE), such as wireline Voice over Internet Protocol (VoIP) phones. This modification is necessary to ensure that users of ACS telephonic CPE can seek remedies from the Commission if they experience any violations of the Commission’s rules for ACS telephonic CPE. New rule section 68.503, adopted in FCC 17-135, by its terms, applies existing sections 68.414-68.423 to ACS telephonic CPE. In particular, sections 68.414 through 68.417 and 68.419 through 68.423, which provide the complaint procedures applicable to legacy wireline telephones, are covered by information collection 3060-0056. This collection projects that the annual number of complaints to be 5. The Commission, however, has been receiving so few complaints, that even by adding in the anticipated complaints for ACS telephonic CPE, the Commission estimates that the average annual number of complaints will still be 5 or fewer. The Commission therefore seeks a non-substantive change to collection 3060-0056 to include section 68.503 to the extent that it applies sections 68.414 through 68.417 and 68.419 through 68.423 to ACS telephonic CPE. Because the Commission does not anticipate any increase in the number of respondents, responses, burden hours, or costs beyond the number of respondents, responses, burden hours, and costs already covered by information collection 3060-0056, the Commission believes that this is a non-substantive change.
