Single Use, Non-Exclusive, Non-Transferable Permission Letter

This letter hereby grants permission for the use of the following Woodsy Owl artwork/materials:

Such permission is only granted with respect to the following product(s):

Such permission is only granted subject to the following additional requirement(s):

This permission is granted on a non-exclusive basis, to include the above referenced intellectual property in the present edition of the above-referenced material. Such permission is granted and applies to all sales of the original production run of up to one unit(s), with sales allowed in perpetuity of the initial run only. Any additional production shall require an alternate permission form.

Grantee is granted the right to show facsimiles of the product or marketing materials in program promotional materials. Grantee shall submit to the Woodsy Owl Licensing Program for approval, at no cost to the Forest Service, with respect to the proposed Product and any proposed Licensed Marketing Material; prior to commencing the development of the proposed Licensed Product or proposed Licensed Marketing Material,

1. a description of the concept of the same, which may include design sketches thereof; prior to the fabrication of pre-production models or prototype samples,

2. final art drawings with specifications and colors; and prior to commencing distribution, sale, or other use,

3. one (1) image of retail materials.

Grantee agrees to pay the US Forest Service $0.00 (ZERO dollars) upon execution of this agreement, as consideration for valuable property herein.

Grantee also shall place on the above referenced product or on sales materials therefore, the statement: "The name and character of Woodsy Owl are the property of the United States, as provided by 16 U.S.C. 580p, p-1, p-3, and p-4 18 U.S.C. 711a and 36 CFR Part 272 and are used with the permission of the Forest Service, U.S. Department of Agriculture." Grantee shall not place on, or in association with, Woodsy Owl artwork any artist's signature or notice of copyright other than the items required by this Paragraph.

Grantee acknowledges that all Woodsy Owl original objects, film positives, printed samples, and reproduction transparencies that are supplied by the Forest Service, remain the exclusive property of the United States. Upon request, all such materials shall be returned to the Forest Service.

Grantee acknowledges that each of the following is the property of the United States, as represented by the Secretary of Agriculture, and that all rights therein and goodwill pertaining thereto belong exclusively to the United States: the name and character of Woodsy Owl, as provided in 16 U.S.C. 580p, p-1 through 580p-4 and 18 U.S.C. 711; any copyrights in Woodsy Owl artwork; and, the expressions “GIVE A HOOT. DON’T POLLUTE!" and “LEND A HAND-CARE FOR THE LAND.”

Grantee further acknowledges that its every use of these properties inures exclusively to the benefit of the United States, as represented by the Secretary of Agriculture, and that Grantee shall not at any time acquire any rights therein by virtue of any use thereof. It is understood and agreed that nothing herein contained shall be construed so as to make the parties hereto partners or joint venturers or to permit the Grantee to bind the United States to any agreement or purport to act on behalf of the United States in any respect.
