Instructions for
Thermal Energy Compliance Report
(40 CFR 74.43 and 74.47)
The Acid Rain Program regulations require the designated representative to submit a Thermal Energy
Compliance Report for each opt-in source that is governed by a Thermal Energy Plan.

STEP 1

Enter the Plant Name, State, Facility Account Number, Compliance Year, and Unit ID for the opt-in
source that is transferring its thermal energy to replacement units.

STEP 2

Enter the actual amount of thermal energy (mmBtu) reduced at the opt-in source during the
calendar year. Include all energy flows (steam, gas, or hot water) used for any process or heating
and cooling application. The actual amount of thermal energy (mmBtu) reduced cannot exceed
the difference between the opt-in source's baseline and its annual utilization (i.e., Step 2 must be
<= Step 2 from the Opt-in Utilization Report - Step 6 from the Opt-in Utilization Report).

STEP 3

Column A: Enter the Unit ID for each replacement unit under the approved Thermal Energy Plan.
Column B: Enter the actual amount of thermal energy (mmBtu) for each replacement unit that is
replacing the thermal energy at the opt-in source during the calendar year. Include all energy
flows (steam, gas, or hot water) used for any process or heating and cooling application. The total
amount of thermal energy (mmBtu) replaced by all replacement units must not exceed the amount
reduced at the opt-in source as reported in Step 2.
Note: The opt-in source must document the total steam output (in mmBtu) from each replacement
unit, the portion of the total steam output used in process or heating and cooling applications, and
the portion used to generate electricity, and be prepared to provide a copy of these records to EPA
upon request.
Column C: Enter the actual number of allowances that may be transferred to each replacement
unit under the approved Thermal Energy Plan calculated as follows.
If the replacement unit is a boiler;

Note: The allowable emission rate for the replacement unit is defined in 40 CFR 74.47(a)(3)(vii).
Column D: Enter the number of allowances that were transferred to each replacement unit under
the approved Thermal Energy Plan (Calculated in Step R-8 of the Thermal Energy Plan Form)
included in the Acid Rain Permit for the opt-in source.
Column E: Subtract Column D from Column C and enter the difference, which is the number of
allowances that will be transferred to or from the replacement unit's facility account.
STEP 4

The designated representative of the opt-in source and the designated representative for each
replacement unit must either:
1) Read the certifications, enter the date, AAR ID number, and sign this form (each designated
representative may sign a copy of the original Thermal Energy Compliance Report; all of the
copies with original signatures should be submitted in the same package.); or
2) Submit a cover letter with a certification statement, following the General Instructions.
