Revision to the Collection Instrument

The President signed Public Law No. 116-165 of the Strengthening Protections for Social Security Beneficiaries Act of 2018, in April. This legislation requires SSA to

re-determine the payee whenever a foster care child’s placement changes, or the child enters or exits foster care, and it makes the State liable for any overpayments if it is the payee at the time the overpayment occurs.

To support this change to the Social Security Act, we are adding two questions to the SSA-11-BK and to the electronic Representative Payee System (eRPS) application collection screens.

• Change #1: We are adding a question to ask whether the child is in foster care.

Justification #1: This question supports a field office's determination of who is the best payee, and it supports reporting on foster care children with payees.

• Change #2: We are adding a question to ask whether a state, county, or local government agency is the applicant.

Justification #2: This question enables us to identify when a State may be liable for any overpayment the recipient incurs.

The Agency will obsolete the previous version of the SSA-11-BK at the time we implement the revised collection instrument.
